In October 2020, police officers shot Khalit Mustafayev dead during a chase near the village of Suvorovskoye in the Stavropol region. Khalit did not stop his car at the request of the officers, and when he was blocked by patrol vehicles, he ran out of the car in an attempt to flee. The policemen fired warning shots, but Mr. Mustafayev did not stop, so one of the officers shot him. The bullet hit the man in the head, and he died.
After the incident, the Investigative Committee opened a criminal case under the article on excess of authority (Part 3 of Article 286 of the Criminal Code) against the relevant officer, Maksim Marchenko. According to the law, he did not have the right to use a firearm to stop the fleeing man. Marchenko’s trial never took place, as in 2022 he went into military service. At that time, the law under which the defendant could go to the special military operation was not yet in effect, but Marchenko received a summons from the military enlistment office, although he was under a written undertaking not to leave the region. The criminal case was suspended because the defendant was unable to participate in the trial.
At the beginning of 2025, lawyers who represent the interests of the Mustafayev family received an apology from the head of the police department of the city of Lermontov.

Khalit Mustafayev’s relatives do not know the whereabouts of Maksim Marchenko or whether it is possible to resume the criminal case. The lawyers sent a petition to the prosecutor’s office to find out whether the grounds for suspending the case have disappeared, as they want to find out whether Mr. Marchenko is alive or not.
